Article 311

Article 311 of the Indian Constitution has provisions related to the dismissal, removal or reduction in ranks of civil servants. Clause 2 of this Act was used to dismiss 11 Jammu and Kashmir government employees for their alleged terror links. These include two sons of Hizbul Mujahideen chief Syed Salahuddin.
According to Article 311(2), a civil servant can be dismissed or removed or demoted only after an inquiry was conducted, with the government servant being informed of the charges and given reasonable opportunity of being heard in respect to those charges. However, subsection of the clause states that this provision does not apply if the President or the Governor is satisfied that such actions are required for safeguarding the national security.
