U.S. Government Proposes National Data Protection Law

The United States government is set to introduce a landmark law, the first of its kind at the national level, aimed at protecting data privacy. The legislation, if passed, will grant individuals the ability to control or even prevent technology firms from using their personal data. This marks a significant move that could redefine how the largest technology companies gather and monetize users’ data.

The Imperative for A Data Privacy Law

The imperative for this regulation arose from growing concerns about the violation of private data by technology giants like Facebook, Google, and Amazon. The U.S. has traditionally adopted a hands-off approach to regulating its booming IT industry, viewing stringent oversight as a potential barrier to free-wheeling innovation. However, the trend appears to be shifting towards more regulation, led by increasing calls for greater accountability from these tech behemoths.

Efforts to Curb Power of Tech Giants

Support for a robust data privacy law is just one part of a larger push by lawmakers and regulators, seeking to reduce the overwhelming power exerted by companies such as Facebook, Google, and Amazon. In a related recent development, the state of California also enacted a similar data privacy law, empowering Californians to see where their data is being collected and distributed, and even decline its sale, with a few exceptions.

In France, the Parliament has approved a new tax plan titled “GAFA”, which stands for Google, Amazon, Facebook, and Apple. This legislation is a response to growing public discontent over the negligible taxes paid by some of the wealthiest corporations in the world.

Closer home, in India, the government has also enforced Data Localisation norms specifically for payment firms. In order to address the pressing issue of data protection, the Indian government constituted the BN Srikrishna Committee and introduced the Data Protection Bill in 2018.

According to the Bill, all personal data subject to the law must have at least one serving copy stored in India. Additionally, data critical to the national interest must only be stored and processed within the country.
