CCPA Issues Guidelines to Protect Consumers from Unfair Service Charges

The Central Consumer Protection Authority (CCPA) has recently issued a set of guidelines designed to prevent unfair trade practices and protect the interests of consumers in hotels and restaurants. This action comes in response to service charges that these establishments have been assessing.

What is the CCPA?

Established under the Consumer Protection Act (CPA) of 2019, the CCPA was created to regulate actions that infringe on consumer rights, engage in unfair trade practices, and present false or misleading marketing that negatively impacts the public. The authority is empowered under Section 18 of the CPA, 2019, to safeguard, advocate for, and defend consumersโ€™ rights, as well as to prevent violations of these rights under the Act. Additionally, the CCPA aims to enhance consumer rights and ensure that no individual partakes in unfair trade practices.

New Guidelines Explained

The newly issued guidelines prohibit hotels and restaurants from automatically adding extra charges to bills in the name of a service charge. These establishments are required to inform their customers that service charges are purely voluntary and optional. Importantly, admission or services cannot be restricted based on the collection of service charges. Hotels and restaurants cannot add service charges to their bills and collect GST on the overall total. Tips and donations are considered separate transactions between the consumer and the hotel staff, fully at the discretion of the consumer.

Redressal Mechanisms for Unfair Service Charges

In the event of a hotel or restaurant levying a service charge, the customer can request the service charge be removed from the bill. If necessary, a complaint can be lodged with the National Consumer Helpline (NCH) by calling 1915 or through the NCH mobile app. The NCH serves as an alternative dispute redressal mechanism at the pre-litigation level. A complaint can also be filed against unfair trade practices with the Consumer Commission electronically via edaakhil.nic.in for speedy and effective resolution.

Understanding Service Charges

A service charge is essentially a tip or transaction between the consumer and restaurant personnel, particularly wait staff. This charge is a fee collected by the hospitality and food and beverage industries for services related to the purchase of a core product or service.

Reason Behind the New Guidelines

The genesis of these new guidelines was a significant number of complaints regarding unnecessary service charges being levied on bills, often disguised as other fees. According to the new rules, charging more than the cost of food items on the menu plus applicable taxes is now considered an unfair trade practice under the CPA.

The Way Forward

These new regulations came into existence due to hotels and restaurants charging exorbitant service taxes and engaging in predatory pricing. Now, customers are not obligated to pay such taxes; instead, it is voluntary. However, the efficient implementation of these regulations across the country remains crucial for their effectiveness.
