Japan Seeks Geographical Indication Tag for Nihonshu

In a unique move, the Embassy of Japan located in New Delhi has taken the initiative to apply for a Geographical Indication (GI) tag for Nihonshu. Intriguingly, this is the first instance in which a product originating from Japan has made an application for such a tag at the Geographical Indication Registry.

About Nihonshu

Nihonshu, more commonly known as Japanese sake, is considered both special and valuable in Japanese culture and society. This beverage has been crafted for centuries by fermenting rice. Although traditionally consumed during significant events like festivals, weddings or even funerals, Nihonshu has made its way into daily consumption. As such, it has become a fundamental aspect of the Japanese lifestyle and culture.

Moreover, the Nihonshu-dominated sake market is recognized as the second biggest market for brewed liquor in Japan, trailing only behind beer.

Understanding Geographical Indication (GI) Tag

A Geographical Indication (GI) tag operates as a marker used to identify and certify goods that possess unique characteristics originating from a specific geographical location.

In India, the process of registering for a GI tag and obtaining protection for geographical indications relating to goods is governed by the Geographical Indications of Goods (Registration and Protection) Act of 1999. As part of the global community, this policy is further driven by the World Trade Organization’s Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

Under Articles 1 (2) and 10 of the Paris Convention, it has been agreed and declared that the safeguarding of industrial property and geographical indication stand as vital elements of intellectual property. A geographical indication may refer to an agricultural, natural or a manufactured product (which includes handicrafts and industrial goods).

The Validity of GI Tag

A GI tag holds validity for a period of 10 years post which it can be extended or renewed.

Significance of the GI Tag

When a product is able to secure a GI tag, it signifies that no individual or company may sell a similar product under that same name. This categorization offers the product legal protection against unauthorised usage by other entities.

In addition, a GI tag plays a significant role in enhancing the exports of the product. With a confirmed origin and assured authenticity, it provides comfort to customers about the genuineness of the product they are purchasing.
