Telecommunication Consumers Education and Protection Fund

Recently, the Telecom Regulatory Authority of India (TRAI) introduced the draft Telecommunication Consumers Education and Protection Fund (Sixth Amendment) Regulation, 2023, seeking feedback from stakeholders. The proposed amendments aim to make changes to the existing Telecommunication Consumers Education and Protection Fund Regulations, 2007. The TCEPF is an essential fund established to cater to consumer-centric activities, emphasizing consumer awareness and protection.

TCEPF Purpose

The primary purpose of the Telecommunication Consumers Education and Protection Fund (TCEPF) is to utilize its income to conduct various consumer-centric activities. These activities include organizing Consumer Outreach Programmes, seminars, workshops, and developing educational materials to raise consumer awareness. By empowering consumers with knowledge and understanding of their rights, the TCEPF aims to create a more informed and protected telecommunications consumer base in India.

Committee for Utilisation of Telecommunication Consumers Education and Protection Fund (CUTCEF)

The activities of the TCEPF are planned and executed by the Committee for Utilisation of Telecommunication Consumers Education and Protection Fund (CUTCEF). This committee plays a crucial role in determining how the funds are allocated for different consumer-centric initiatives. It comprises members from various stakeholders, including representatives from the telecom industry, consumer rights organizations, and government authorities. The CUTCEF’s effective functioning is pivotal in ensuring transparency and accountability in managing the TCEPF.

Proposed Amendments

The draft regulation proposes amendments to Regulations 06 and 13 to address specific issues related to the preparation, maintenance, and audit of accounts. These amendments aim to enhance the fund’s management and ensure more robust financial oversight. Additionally, the draft seeks to promote consumer representation in the decision-making process. It proposes the participation of consumer group representatives in CUTCEF meetings, which can be instrumental in incorporating consumer perspectives in planning and executing consumer awareness initiatives.

Impact of Bank Merger

In 2020, Corporation Bank, where the TCEPF was maintained, underwent a merger with Union Bank of India. This bank merger could have implications for the fund’s management and operations. The draft regulation likely takes into account the changing financial landscape after the merger to ensure seamless management and utilization of the TCEPF’s resources.

Seeking Public Input

To ensure a comprehensive and inclusive regulatory process, TRAI has made the draft regulation available on its official website http://www.trai.gov.in. The regulatory authority welcomes stakeholder comments and suggestions until August 14, 2023. This open consultation period allows consumers, telecom operators, consumer rights organizations, and other stakeholders to provide valuable inputs and shape the final version of the regulation.
