The recent arrest of five teenagers in Kerala for an attack on a 23-year-old man has once again highlighted the growing concern of moral policing in India. This incident represents a larger, worrying trend that is creeping into Indian society.
Understanding Moral Policing
Moral policing is a term often used to describe a system where strict vigilance and restrictions are imposed on individuals deemed to be violating societal standards. These standards are typically derived from local cultures, traditions, and religious doctrines. The practice of moral policing invariably leads to a situation where an individual’s moral character is scrutinized by those advocating for these societal norms.
Manifestations of Moral Policing
There are several ways in which moral policing is expressed in Indian society. These include mob lynching, cow vigilantism, cultural terrorism, and honor killing.
Mob lynching refers to a form of violence where a mob executes a presumed offender without a trial, often after inflicting severe physical harm. Cow vigilantism involves the protection of cows, which are revered in Hinduism. Instances of lynching under the guise of cow protection have led to numerous deaths and pose a serious threat to the nation’s secular fabric.
Cultural terrorism is another disturbing trend. Extra-constitutional actors, such as Anti-Romeo Squads, impose their subjective beliefs through physical violence. Honor killings, particularly brutal examples of moral policing, aim to suppress western influences by severely violating individual freedoms.
Moral Policing and Fundamental Rights
Often, moral policing infringes upon the fundamental rights of citizens that are constitutionally guaranteed, such as the right to freedom of speech & expression, privacy, and living with dignity. For example, the LGBT community is particularly vulnerable to moral policing, with their right to life and liberty frequently threatened.
Factors Promoting Moral Policing
Several factors contribute to the propagation of moral policing in India. Religious values, particularly those associated with the Hindu reverence for cows, often lead to cow vigilantism. Social networking platforms such as Whatsapp and Facebook can exacerbate moral policing by amplifying the spread of fake news.
Patriarchal mindsets that view women as a weaker sex requiring protection can also result in moral policing, with restrictions imposed on women’s speech, attire, and public behavior. Police overreach is another significant factor, with law enforcement officials occasionally using their powers excessively or misinterpreting laws, such as Section 292 of the Indian Penal Code and the Immoral Traffic (Prevention) Act.
Proposed Remedies
One of the ways to counter the issue of moral policing is by reforming the criminal justice system. Such reforms should include sensitizing law enforcement officials and the judiciary to constitutional values. Public discussion and debates in educational institutions can help create awareness and sensitivity towards the harmful consequences of moral policing.
