The Ladakh administration recently initiated a policy to issue Resident Certificates exclusively to those who hold Permanent Resident Certificates (PRC) from the region. This approach notably deviates from Jammu & Kashmir’s (J&K) new domicile laws which allow non-residents to apply for jobs, land, and other facilities. The former practice of reserving all job opportunities in J&K, including Ladakh, solely for permanent residents was part of Articles 370 and 35A of the Indian constitution.
Overview of the New Policy
The revised policy adopted by the Ladakh administration allows only individuals who possess a PRC conferred by competent authority in the districts of Leh and Kargil or those who would have been eligible for a PRC to receive the Resident Certificate. In addition, it increases the upper age limit for entering government services against all positions. This age relaxation is a one-off exception, and will remain in place for two years.
Aims of the Residents Certificate Initiative in Ladakh
The main objective behind this initiative is to provisionally outline the definition of a resident of the Union Territory of Ladakh. This definition pertains specifically to appointments for non-gazetted posts within any department or service under the administration of Ladakh.
The Role and Importance of Permanent Residence Certificates (PRCs)
A PRC is essentially a domicile certificate. It assists people in obtaining domicile-related quotas in government jobs and enrollment in educational institutions. States such as Arunachal Pradesh, Assam, Mizoram, Meghalaya, Tripura, and Manipur issue PRCs in India.
The PRC finds its purpose as a legal document providing proof of residence, making it a necessary requirement where proof of residence is needed. It’s used in varied scenarios such as seeking admission in educational organizations, job reservations under specific quotas (particularly for government jobs), to get local preferences, acquiring a ration card, casting a vote in elections, and availing benefits of various state schemes or scholarships.
This new approach adopted by the Ladakh administration highlights the unique considerations required when managing residency and employment rights in these regions. With PRCs playing a pivotal role as proof of residence in India, their importance is further amplified within the context of Ladakh’s freshly defined residency rules.
