Meghalaya High Court Highlights Conservation-Development Challenge

The environmental conservation and economic development of North Eastern India presents a paradox marked by the need to maintain the region’s beauty while also promoting tourism and infrastructure development. This challenge was recently highlighted in the Meghalaya High Court’s 2023 ruling on the case of Re: Cleanliness of Umiam Lake versus State of Meghalaya, where it underscored the importance of preserving the state’s natural beauty amidst the absence of alternative employment opportunities. There is an emerging urgency for striking a balance between developmental interests and environmental preservation in this richly biodiverse region.

Public Interest Litigation and Environmental Conservation in Northeast India

The Meghalaya High Court recently heard a Public Interest Litigation (PIL) concerning the cleanliness of Umiam Lake. The case raised awareness of the detrimental effects unregulated construction and excessive tourism can have on regional water bodies. In its ruling, the court underscored the importance of not sacrificing the environment in the name of economic development and criticized the Meghalaya Water Bodies (Preservation and Conservation) Guidelines, 2023, for their insufficient provisions against unchecked construction around the water bodies.

The Intersection of Biodiversity and Development in Northeast India

Northeast India, known for its lush green landscapes, abundant natural resources such as oil, natural gas, minerals, and freshwater, is a biodiversity hotspot. Important biodiversity regions include the Garo-Khasi-Jaintia hills and the Brahmaputra valley, which together form part of the Indo-Burma hotspot. This region, though industrially backward, sees significant environmental damages due to deforestation, flooding, and industry-related pollution.

Legal Frameworks and Challenges in Environmental Protection

The Sixth Schedule of the Constitution grants District Councils autonomy over land use, limiting state authority. This autonomy can sometimes lead to inadequate regulations, as seen in the case of Umiam Lake. Legal mechanisms such as PILs and judicial activism play a critical role in enforcing environmental protections, as evidenced by the National Green Tribunal imposing fines on states for environmental violations.

Promoting Sustainable Growth in Northeast India

Tools like the North East Industrial Development Scheme (NEIDS), 2017, can help promote sustainable growth in the region. NEIDS includes a ‘Negative List’ to ensure that only environmentally compliant entities receive incentives. The ‘Act Fast for Northeast’ policy should extend to include not only “trade and commerce” but also the preservation of “environment and ecology”. A uniform, comprehensive environmental legislation is needed to bridge regulatory gaps and align economic growth with environmental sustainability.

Umiam Lake: An Emblem of Environmental Protection and Development Paradox

Umiam Lake, one of Meghalaya’s largest artificial lakes located about 15 km from Shillong, symbolizes the tension between development and conservation. The lake was created as a reservoir following a dam construction project on the Umiam River, also known as the Barapani River, to facilitate hydroelectric power generation. As such, it exemplifies the potential for regional development while underscoring the need for balanced, sustainable growth practices.
