Recently, in a significant reform, the Supreme Court endorsed the initiation of a system for the electronic transmission of its orders. This move is poised to facilitate the efficient implementation of Article 21 (right to life). Preceding this reform, the Chief Justice of India (CJI) introduced an Artificial Intelligence (AI)-powered portal ‘SUPACE’ into the judicial system. This portal is designed to aid judges with legal research.
System Overview: What it Proposes
The proposed system aims to electronically transmit authenticated copies of interim orders, stay orders, bail orders, and records of proceedings to the duty holders. These documents are intended to be sent through secure electronic communication channels, facilitating compliance and prompt execution.
The Need for the System
Several cases have emerged where jail inmates have not been released on time despite the court issuing bail orders. This delay primarily arises from the slow communication of bail orders. Hence, there’s a pressing need to leverage information and communication technology tools to expedite the transmission of the court’s orders.
Significance of the System
One of the most notable advantages is that this will prevent undertrials – individuals yet to be found guilty of their accused crimes – from enduring unnecessary waits for their release from prison. The issue often lies in the certified hard copies of their bail orders taking too long to reach the prison authorities.
Furthermore, the new system can also help avoid unnecessary arrests and detention of individuals, even after the court has already granted them protection. This also ensures timely communication of a stay on any execution ordered by the final court.
Challenges Implementing the System
While the proposed system promises numerous benefits, implementing it is not without its set of challenges. Long-established issues like inconsistent internet connectivity in jails across the nation could hinder the efficient electronic transmission of orders. Unless this facility is readily available, the smooth execution of such orders will remain a challenge.
Conclusion
Despite some hurdles, the electronic transmission system endorsed by the Supreme Court marks a significant step towards leveraging technology for judicial efficiency. The major aim is to safeguard the rights of citizens and ensure speedy execution of court orders, which is a crucial aspect of our legal system.
