The district judiciary refers to the judicial system at the district level in India. It is the first level of the judiciary and is responsible for hearing and deciding cases at the local level. This tier of the judicial system consists of district courts and other lower courts, presided over by district judges and other judicial officers.

Articles 233-237 of the Indian Constitution provide the legal framework for the functioning of subordinate courts in India. This includes the appointment process, recruitment, control and management of district courts and the definition of “judicial service”. The Governor of each state, in consultation with the High Court, is vested with the power to appoint district judges, as per Article 233.

In a landmark judgment, the Supreme Court declared the independence of the district judiciary as an integral part of the Constitution’s basic structure. The Court emphasized that without impartial and independent judges at the grassroots level, the preambular objective of ensuring justice would remain fictitious. The Court discarded the term “subordinate judiciary” as it misrepresented the constitutional position of a district judge.
The Vital Role of the District Judiciary in Upholding Rule of Law
The Supreme Court recognised the district judiciary’s significant role in upholding the rule of law and delivering justice. With approximately 1.13 million cases dealt daily, it is the most accessible court for litigants. Its efficiency was evident even during the pandemic, ensuring a timely delivery of justice.
Financial Security and Economic Independence for Judicial Officers
To maintain impartiality, it is crucial to ensure the independence of judicial officers serving in the district judiciary. This includes providing them with financial security and economic independence. Despite no pay revision in nearly 15 years, judicial officers continue to diligently perform their duties.
Supreme Court’s Recommendations and Directions
Recognising these conditions, the Supreme Court ordered an enhancement to salary, pension, and other retirement benefits for judicial officers. It recommended that the pay of judicial officers should be stand-alone and should not be compared with staff in the political executive or legislature. The Court also suggested incentives and promotion opportunities to maintain the high level of functioning of judiciary. These recommendations underscore the paramount importance of the district judiciary and its officers in maintaining the rule of law in India.
