BJP leader Pravin Darekar moved a breach of privilege motion in the Maharashtra Legislative Council against BMC Commissioner Iqbal Singh Chahal. The Motion was moved for not responding to letters he wrote to the civic chief on issues including COVID-19.
Background
Darekar had written letter to the Brihanmumbai Municipal Corporation (BMC) chief on issues like COVID-19, dilapidated buildings, illegal structures and cleaning of drains in Mumbai.
Privilege Motion
Privilege Motion is granted to the Members of Parliament. These are certain privileges individually and collectively that mandates to perform their duties properly. If any of the members disregard or misuses the privileges or rights, it is called as a breach of the privilege motion. The motion is applicable for members of Lok Sabha as well as Rajya Sabha. It is mentioned in Chapter 20 of rule 22 for Lok Sabha and Chapter 16 Rule 187 for the Rajya Sabha.
Breach of Privilege Motion
A breach of privilege is a misuse of any of the privileges of MPs or Parliament. Breach of privilege motion is punishable under the Parliamentary laws. The breach of this motion in the Lok Sabha is looked upon by the Speaker and in the Rajya Sabha it is looked upon by the Chairperson.
Parliamentary Privileges
These are the rights and immunities that are enjoyed by Parliament in its institutional capacity as well as by the Member of Parliament in their individual capacity. Without such privileges, they cannot discharge their functions that are prescribed to them by the Constitution.
