Jadhav’s Appeal Right Granted: Pakistan

The Pakistan National Assembly passed a significant piece of legislation known as the ICJ (Review and Re-consideration) Bill, 2020. This bill is particularly noteworthy because it aims to address an international legal matter concerning an Indian prisoner named Kulbhushan Jadhav. The bill grants Jadhav the right to appeal, which aligns with the directives of the International Court of Justice (ICJ). It also ensures that he is granted consular access, fulfilling Pakistan’s obligations under the ICJ’s verdict.

Introduction of ICJ (Review and Re-consideration) Bill, 2020

The ICJ (Review and Re-consideration) Bill, 2020, was introduced as a direct response to the ICJ’s ruling regarding the case of Kulbhushan Jadhav. The bill’s primary objective is to formalize the legal process for Jadhav to appeal his death sentence, which was handed down by a Pakistani military court. Kulbhushan Jadhav’s Case Background

Kulbhushan Jadhav is a retired officer from the Indian Navy who was arrested in March 2016 in Balochistan, Pakistan. Pakistan accused him of espionage and terrorism and claimed that he was operating under the alias Hussain Mubarak Patel. In April 2017, a Pakistani military court found Jadhav guilty of these charges and sentenced him to death. The trial and sentence were conducted in a closed military court, which raised several questions about the transparency and fairness of the proceedings.

India’s Appeal to the International Court of Justice

Following the sentencing of Jadhav, the Indian government took the matter to the International Court of Justice. India contested the charges against Jadhav and argued that Pakistan had violated the Vienna Convention on Consular Relations by not granting consular access to him. The ICJ, located in The Hague, Netherlands, is responsible for settling legal disputes between states and giving advisory opinions on international legal issues.

The ICJ’s Verdict and Directives

In July 2019, after hearing the arguments from both sides, the ICJ delivered its verdict. The court affirmed that Pakistan had indeed breached the Vienna Convention by failing to provide consular access to Jadhav. The ICJ ordered Pakistan to review and reconsider Jadhav’s conviction and sentence, effectively staying his execution. Additionally, the court directed Pakistan to provide Jadhav with the opportunity to be represented by legal counsel for his defense and to allow him access to the necessary consular services.

The passage of the ICJ (Review and Re-consideration) Bill, 2020, by Pakistan’s National Assembly is a critical development in the case of Kulbhushan Jadhav. The bill is intended to pave the way for Jadhav to have a fair chance to appeal his conviction in a civilian court, which is expected to be more transparent than the military court proceedings. Furthermore, the bill is a gesture towards upholding international law and Pakistan’s commitment to the rulings of the ICJ.
