Online Gaming Industry Adopts Voluntary Ethics Code

Recently, the online gaming sector in India has voluntarily adopted a code of ethics, marking a significant self-regulation attempt. This initiative aims to build a stable environment within the gaming industry. The Government of India has assigned responsibility for online gaming matters to the Ministry of Electronics and Information Technology.

Understanding the Code of Ethics

To self-govern and address burgeoning issues, three leading lobby groups, namely the Internet and Mobile Association of India (IAMAI), E-Gaming Federation (EGF), and All India Gaming Federation (AIGF) have co-signed this voluntary code of ethics. Although non-binding, it aims to promote responsible industry practices and protect consumer interest.

Under the code, online gaming companies are required to implement know-your-customer (KYC) procedures as per the law. They must also disclose their winner determination criteria, fees charged, and ensure that deposits are used exclusively for platform gaming. Overall, the code strives to foster a healthy and fair online gaming environment.

Online Gaming Vs Gambling

Online gaming refers to games played over the internet, providing a platform for players from different locations to connect. This can be accessed through various devices, including computers and mobile phones. On the contrary, gambling involves betting on events with uncertain outcomes, often with financial or material stakes.

In India, games of chance are considered gambling and are generally prohibited, while skill-based games are exempted. In the landmark case of RMD Chamarbaugawala v. Union of India, the Supreme Court relied on the ‘skill test’ to differentiate between gambling activities and games of skill.

Government Regulations and Their Alignment with the Code

Despite focusing on physical gambling activities, the Public Gambling Act, 1867 has relevance in the online gaming sphere, offering a legal framework for its regulation. The Information Technology Act of 2000 also plays a crucial role in governing online activities, including gaming. Sections 67, 67A, and 67B enable authorities to formulate laws related to online gaming, aligning with the constitutional jurisdiction division.

The Ministry of Electronics and Information Technology has introduced rules permitting the establishment of self-regulatory bodies within the online gaming industry. Moreover, the government’s proactive approach is visible in the recommendations put forth by the inter-ministerial task force for formulation of online gaming rules.

Way Forward

For effective compliance with the code’s provisions, the industry needs to invest in technology solutions such as robust KYC procedures and transparent disclosure mechanisms. Technologies like blockchain could be used to enhance transparency and fairness.

Establishing a system for regular audits and reporting is also critical. Additionally, a robust feedback mechanism that allows players to voice their concerns and suggestions on the industry’s adherence to the code would help in continual improvement.

Lastly, the industry should stay informed about international best practices in online gaming ethics and consider incorporating successful measures from other jurisdictions.
