TRAI’s Draft Telecommunication Consumers Education and Protection Fund (Sixth Amendment) Regulation, 2023

Recently, the Telecom Regulatory Authority of India (TRAI) took a significant step towards enhancing consumer protection and awareness in the telecommunication sector by introducing the draft Telecommunication Consumers Education and Protection Fund (Sixth Amendment) Regulation, 2023. This draft regulation aims to make vital changes to the existing Telecommunication Consumers Education and Protection Fund (TCEPF) Regulations, 2007. The proposed amendments focus on improving the fund’s activities and addressing emerging challenges in the rapidly evolving telecom industry.

The Purpose of TCEPF

The TCEPF was established to utilize its income for various consumer-centric activities. The fund’s primary objective is to conduct Consumer Outreach Programmes, seminars, workshops, and develop educational materials to raise awareness among consumers regarding their rights, responsibilities, and available options in the telecommunication domain. The fund plays a crucial role in empowering consumers to make informed choices and safeguard their interests.

Role of CUTCEF

The committee for Utilisation of Telecommunication Consumers Education and Protection Fund (CUTCEF) is responsible for planning and executing the activities funded by TCEPF. It consists of representatives from various stakeholders, including the telecom industry, consumer groups, and regulatory authorities. The CUTCEF’s collaborative approach ensures that decisions align with the interests of both consumers and the telecom sector.

Proposed Amendments in Regulations

To strengthen the functioning of TCEPF and adapt to the changing landscape, several key amendments have been proposed in regulations 06 and 13 of the principal TCEPF Regulations, 2007.

  • Improved Preparation, Maintenance, and Audit of Accounts: One of the proposed amendments focuses on enhancing the preparation, maintenance, and audit of accounts related to the TCEPF. This measure aims to improve transparency and accountability in fund utilization, ensuring that the resources are efficiently deployed for consumer-centric initiatives. By streamlining financial procedures, the fund’s activities can be better monitored and evaluated for their impact on consumers.
  • Participation of Consumer Groups in CUTCEF Meetings: Recognizing the vital role played by consumer groups in representing consumer interests, the draft regulation seeks to increase their participation in CUTCEF meetings. This amendment intends to foster a more inclusive decision-making process, where consumers’ perspectives are heard and considered in shaping the fund’s initiatives. By giving consumer groups a more significant role, the regulation aims to ensure that the TCEPF remains focused on addressing consumers’ actual needs and concerns.

Adaptation to Recent Changes

The year 2020 witnessed significant changes in the financial and regulatory landscape, impact the functioning of TCEPF. With the merger of Corporation Bank, where the TCEPF was maintained, into the Union Bank of India, there arose a need to make necessary adjustments in the existing regulations to reflect the new financial arrangements.
