Inclusive Welfare Governance

In welfare economics, inclusive governance is an institutional approach that corrects systemic market failures by directing state capacity toward marginalized and structurally disadvantaged sections of society. Within the Social Sector Schemes of the Indian economy, inclusive welfare governance operationalizes constitutional promises into tangible entitlements. It focuses on the socioeconomic mainstreaming of Scheduled Castes (SCs), Scheduled Tribes (STs), Persons with Disabilities (Divyangjan), and Historically Disadvantaged Groups. These interventions are critical for achieving Sustainable Development Goal (SDG) 10 (Reduced Inequalities), SDG 1 (No Poverty), and SDG 5 (Gender Equality), transforming traditional charity-based relief into rights-based statutory safety nets.

Constitutional and Legislative Framework

The architecture of inclusive welfare governance in India is legally anchored across specific constitutional articles and rights-based statutes:

  • Article 15(4) and 15(5): Empowers the State to make special provisions for the advancement of socially and educationally backward classes of citizens, or for the Scheduled Castes and Scheduled Tribes.
  • Article 17: Abolishes “Untouchability” and forbids its practice in any form, forming the constitutional basis for punitive and welfare legislations.
  • Article 46: A Directive Principle of State Policy (DPSP) mandating the State to promote with special care the educational and economic interests of the weaker sections of the people, and in particular, of the Scheduled Castes and the Scheduled Tribes, and to protect them from social injustice and all forms of exploitation.
  • Article 338, 338A, and 338B: Mandates the creation of National Commissions for Scheduled Castes (NCSC), Scheduled Tribes (NCST), and Backward Classes (NCBC) respectively to monitor safeguards.
  • Rights of Persons with Disabilities (RPwD) Act, 2016: Increased the reservation for persons with benchmark disabilities in public employment from 3% to 4%, and in higher education institutions from 3% to 5%, while expanding the recognized disability types from 7 to 21.
